Callbreak Score Tracker Terms & Conditions

These Terms and Conditions (the "Terms") form a legally binding agreement between you and Bimal Khatri ("we", "us", "our") governing your access to and use of Callbreak Score Tracker on ios and android (the "App"). They take effect on June 15, 2026.

Our Privacy Policy is incorporated into these Terms by reference. In these Terms, "you" means the person using the App.

By downloading, accessing, or using Callbreak Score Tracker, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use Callbreak Score Tracker.

You must be at least 13 years old (or the age of digital consent in your jurisdiction, whichever is greater) to use Callbreak Score Tracker. By using it, you represent that you meet this requirement and have the legal capacity to enter into this agreement.

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use Callbreak Score Tracker for your personal use. This license depends on your compliance with these Terms, and we reserve all rights not expressly granted.

Your use of Callbreak Score Tracker on Apple devices is also subject to Apple's Licensed Application End User License Agreement (Apple's standard EULA).

You agree not to:

• use Callbreak Score Tracker for any unlawful or unauthorized purpose;
• violate the rights of others, including intellectual-property and privacy rights;
• reverse-engineer, decompile, or attempt to extract the source code of the App, except where the law expressly permits;
• copy, resell, rent, sublicense, or commercially exploit the App without our permission;
• use bots, scrapers, or other automated means to access the App;
• interfere with, overload, or disrupt the App, its servers, or its security;
• attempt to gain unauthorized access to any account, system, or network;
• upload or transmit malware or other harmful code;
• impersonate any person or misrepresent your affiliation with anyone;

We may investigate suspected violations and take action, including suspending or terminating your access.

Callbreak Score Tracker — including its software, design, user interface, graphics, text, logos, and trademarks — is owned by Bimal Khatri and is protected by intellectual-property laws. No rights are granted to you except the limited license described above. You may not use our name or logos without our written permission.

Callbreak Score Tracker may contain links to third-party websites, services, or resources that we do not control. We provide them for convenience only and are not responsible for their content or practices. Using them is at your own risk and subject to their terms.

Callbreak Score Tracker IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT Callbreak Score Tracker WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Bimal Khatri WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE Callbreak Score Tracker. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 100. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH, PERSONAL INJURY, OR FRAUD.

You agree to indemnify, defend, and hold harmless Bimal Khatri and their respective officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of Callbreak Score Tracker, your violation of these Terms or any law, or your infringement of any third-party right.

You may stop using Callbreak Score Tracker at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, for legal or security reasons, or if we discontinue Callbreak Score Tracker. When your access ends, the license granted to you ends and you must stop using Callbreak Score Tracker. Sections that by their nature should survive — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law — survive termination.

These Terms are governed by the laws of Nepal, without regard to its conflict-of-law rules. The courts of Nepal have exclusive jurisdiction over any dispute, except where mandatory consumer-protection law in your home country gives you the right to bring proceedings there.

Before starting any formal claim, you agree to contact khattribimal90@gmail.com and try to resolve the dispute informally for at least 30 days.

We may update these Terms from time to time. When we do, we revise the effective date above and post the updated Terms in the same place. For material changes, we give reasonable notice in the App or by email. Your continued use of Callbreak Score Tracker after the changes take effect means you accept them.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions stay in effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with our Privacy Policy, are the entire agreement between you and Bimal Khatri regarding Callbreak Score Tracker and replace any prior agreements. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, acquisition, or sale of assets.

These Terms are between you and Bimal Khatri, not Apple. Apple has no obligation to provide support or to handle any warranty claims relating to Callbreak Score Tracker. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. embargo and are not on any U.S. list of prohibited or restricted parties.

Your use of Callbreak Score Tracker obtained through Google Play is also subject to the Google Play Terms of Service.
